Employers are generally allowed to choose whether or not copies of original documents are kept. If you are a member of e-verify, you may be instructed by them to keep certain copies. Either way, you need to have a written policy and procedure defining whether or not you keep copies. All employees must be treated the same way. So, you cannot pick and choose whose copies you keep. It’s all or none – plus a written policy to back up your actions.
